Application to Extend Lapsing Period of Development Consent

Information

Section 4.54 of the Environmental Planning and Assessment Act 1979, as amended, states: "If, in granting a development consent, the consent authority reduces the period after which the consent lapses to less than 5 years, the applicant or any other person entitled to act on the consent may apply to the consent authority, before the period expires, for an extension of 1 year."

Rules

a.   You can only apply for this extension once.
b.   Extensions are valid for 1 year, irrespective of the term originally granted.
c.   You must lodge this form and pay the required fee prior to the lapsing date of your consent.
d.   You cannot get an extension to your consent if the consent was granted for 5 years.

Fees

Please refer to Council's Fees and Charges for current fees. If lodging multiple applications, a separate payment must be made for each application. Payment must be made within three days of receiving payment advice.

Political Donations Statement

In accordance with Section 10.4 of the Environmental Planning and Assessment Act 1979, the applicant (or any other person with a financial interest in the application) must disclose any reportable political donations or gifts they have made in the two years before the application is made. The disclosure requirements continue to apply until the application is determined. Reportable political donations include donations of $1,000 or more.

If you (or any other person with a financial interest in the application) have made a reportable political donation or gift within the period of two years, please complete a Disclosure Statement of Political Donations and Gifts Where Council is the Approval Authority.
